Our office strives to keep our clients up-to-date on legal changes. Social Security has issued two significant changes that will impact anyone receiving or setting up their MySocialSecurity account. Please read and share this critical post.


1. Login Change for My Social Security Users

If you access your account with ID.me, you must transition to Login.gov credentials.

  1. Go to ssa.gov/myaccount.

  2. Choose Sign In with Login.gov and follow the prompts.

  3. Keep your existing email handy; SSA will link your records automatically.

2. New Overpayment Rule: SSA Will Now Withhold 50 % of Your Monthly Benefit

  • What changed?
    * For years, the Social Security Administration (SSA) collected overpayments by keeping just 10 % of a recipient’s check.
    * On March 27, 2025, SSA signaled it would switch to 100 % withholding.
    * After public pushback, SSA settled on a 50 % default rate, effective April 25, 2025.

  • Who is affected?
    * Anyone who receives Title II (SSDI or retirement) benefits and has a new or “matured” overpayment (COM 08 and later).
    * The 10 % rule still applies to overpayments identified before COM 07 and to all SSI (Title XVI) cases.

    1. Check your notice dates. The withholding rate is locked until SSA first issued an overpayment letter.

    2. Act within 90 days. You may request a lower rate, a reconsideration, or a complete waiver—but only if you respond before the deadline.

    3. Document hardship. SSA will consider your basic living expenses when reducing the 50 % rate.
